[Business Activation Forum] Ordinary Wages and HR Implications
AustCham invites members and their guests to attend our April Lunch Forum on “Understanding the Supreme Court En Banc Decision Ruling on Ordinary Wages”.
On December 18, 2013, the Supreme Court of Korea (the “Supreme Court”) issued a landmark en banc decision on two of the most anticipated cases concerning “ordinary wages.” In the decision, the Supreme Court provided standards to determine what types of payments should be included in computing ordinary wages. In particular, the Supreme Court ruled that regular bonuses should be included in ordinary wages, but an employee’s claim for overtime, night-time or holiday compensation may not be allowed if it violates the principle of good faith.
